1. General
1.1. The general terms and conditions of Talheim Records e.U. apply to all contracts, deliveries and other services of the company. Any deviating conditions of our contractual partners are hereby expressly rejected.
1.2. Any future changes to the general terms and conditions apply to all orders/orders that are made after the time of change.
1.3. Orders can only be placed by persons who have reached the age of 18. Persons under the age of 18 require the consent of their legal guardian.
2. Conclusion of contract
2.1. The customer's order represents an offer. A contract is only concluded after acceptance on our part. After an order has been received, our system sends an automatic confirmation email. However, this does not constitute acceptance. If there are no concerns about the conclusion of the contract, we will send a separate email shortly afterwards confirming the conclusion of the contract.
2.2. For orders paid in advance, the amount must be received in our account within 7 days of the conclusion of the contract. If this payment deadline is not met, we may withdraw from the contract without granting a further grace period and sell the goods elsewhere.
3. Delivery and shipping costs
3.1. The delivery and shipping costs associated with the order can be found under the attached link. If a customer exercises his statutory right of withdrawal/cancellation, he must bear the direct costs of returning the goods.
4. Payment options
4.1. The individual possible payment methods can be found under the attached link. The customer will only be charged the actual fees incurred or, if it is not technically possible to calculate them, lower flat rates.
5. Delivery
5.1. The goods will be sent with the shipping partner (Austrian Post AG). We only offer insured shipping within the EU.
6. Unavoidable delivery delays
6.1. The delivery times can be found under the attached link.
6.2. Delivery and service delays due to force majeure or other events that make delivery or service significantly more difficult or even impossible, such as operational disruptions, strikes, official orders, fire and water damage, trade embargoes, natural disasters, even if these occur with our suppliers or their deliverers, release us from compliance with specific and bindingly agreed delivery deadlines.
6.3. If the delivery does not arrive within the period specified under the delivery and shipping costs, please contact us. Talheim Records e.U. will then investigate the whereabouts of the goods as soon as possible.
7. Claims for compensation / reminder fees
7.1. Misconduct by the customer can lead to damages for our company. We remind you of our right to assert claims for damages.
7.2. Additional costs are incurred, for example, if the customer refuses to accept the delivery or if the parcel service returns the order due to unsuccessful delivery. These costs will be invoiced to the customer.
7.3. In the event of an invoice not being paid on time, we will charge a flat-rate processing fee of EUR 40. However, we expressly reserve the right to assert further damages that we incur in the course of our legal proceedings (for example due to the involvement of a debt collection agency or a lawyer).
7.4. If the customer is unable to make payments on time, he should contact us immediately. Although there is expressly no legal obligation to grant deferments or installment payments, we signal our fundamental willingness to discuss this. We will endeavour to find an amicable solution.
8. Warranty
8.1. It is pointed out that, unless otherwise agreed, the warranty claims are based on the statutory provisions of the law of purchase (insb. §§922 ff. ABGB).
9. Liability for damages
9.1. We are not liable for property damage caused by slight negligence.
10. Retention of title
10.1. Goods delivered by us remain the property of Talheim Records e.U. until full payment has been made.

12. Criminal conduct
12.1. We will also report fictitious orders or the provision of false data with the intention of causing harm to the person concerned as a criminal offense if we consider it necessary for the public prosecutor to intervene.
13. Place of jurisdiction / choice of law
13.1. Unless mandatory consumer protection regulations provide otherwise, every contract concluded by Talheim Records e.U. is subject to the German Consumer Protection Act. Austrian law, whereby the competent court at the registered office of Talheim Records e.U., Vienna, has jurisdiction.
14. Severability clause
14.1. The invalidity of one of the individual provisions of this contract does not result in the invalidity of the entire contract. The remaining contents of the contract remain unchanged.
